Terms of Service

These Terms of Service ("Terms") govern your use of Modutrack — the website and application available at modutrack.com — operated by an individual based in Australia ("we", "us", "our"). By creating an account or using Modutrack, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

1. The service

Modutrack is a personal asset and parts tracker: it lets you record assets, the components installed on them, service history, maintenance schedules, and related costs, and optionally share an account with other people you invite. The service is provided on an as-available basis and may change over time as features are added, modified, or removed.

2. Your account

You sign in with a Google account and are responsible for activity that happens under your session. You must provide accurate information and keep control of the Google account you use to sign in. You may delete your account at any time from Settings; see the Privacy Policy for what happens to your data.

3. Your content

The data you enter — assets, components, service records, notes, names, photos and similar ("your content") — remains yours. You grant us only the rights needed to operate the service: to store, process, back up, and display your content to you and to the members of any shared account you put it in. We do not sell your content.

You are responsible for what you store. Do not upload content that is unlawful, that you have no right to store, or that infringes anyone else's rights.

4. Acceptable use

You agree not to:

  • attempt to access other users' or accounts' data;
  • probe, disrupt, overload, or interfere with the service or its infrastructure;
  • use automated means to scrape or bulk-extract data other than the export tools we provide;
  • reverse engineer the service except where the law permits it regardless of this term;
  • use the service for anything unlawful.

We may suspend or terminate access that breaches these Terms.

5. Shared accounts

If you join a shared account, the data in that account is visible to its members according to their roles, and the account's owner controls membership, ownership transfer, and deletion of the shared account. If you leave (or are removed from) a shared account, content you added to it stays with that account.

6. Advertising and third-party services

The service may display advertising (for example via Google AdSense) and relies on third-party providers — such as Google for sign-in and our hosting and database providers — to operate. Their services are governed by their own terms.

7. Disclaimers

Modutrack is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Modutrack is a record-keeping tool: maintenance reminders and health indicators are informational only and are no substitute for professional inspection or your own judgement about the safety and serviceability of your equipment.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, profits, or goodwill, arising from your use of (or inability to use) the service. Where liability cannot be excluded — including under the Australian Consumer Law — it is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied. Nothing in these Terms excludes rights you have under law that cannot be excluded.

9. Termination

You can stop using Modutrack and delete your account at any time. We may suspend or terminate the service or your access to it for breach of these Terms or if the service is discontinued; where practical, we will give you a reasonable opportunity to export your data first.

10. Changes to these terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest revision, and material changes will be flagged in the app. Continuing to use Modutrack after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Queensland, Australia, and disputes are subject to the non-exclusive jurisdiction of its courts.
